By registering as a TownHALL Member, you warrant that the information you provide to us, including the personally identifying information, is true and accurate. You accept responsibility for all activities that occur under your account or password, and agree not to sell, transfer or assign your Membership or any Membership rights. We reserve the right to terminate your Membership at any time for any reason. You are responsible for maintaining the confidentiality of your password. If you believe someone has accessed MyTownCrier.ca using your member name and password without your authorization, e-mail us immediately at abuse@MyTownCrier.ca. If you do not agree with the terms of this Agreement, you should not become a TownHALL member. This agreement will remain in effect while you use the Site and/or are a TownHALL Member. You may terminate yourMembership at any time by clicking on the “Deactivate Account” link found on your TownHALL Profile. Please allow 24 to 48 hours for your Membership to be deactivated.
All TownHALL Member postings, messages, text, files, images, graphics, photos, audio clips, sounds, video or other materials (the "Content") posted on, transmitted through, or linked from this Site, are the sole responsibility of the person from whom such Content originated. As a Town Crier visitor or a TownHALL Member, you are entirely responsible for all Content that you post, email or otherwise make available through the Site. For all Content provided by you, you agree to indemnify MyTownCrier.ca, its affiliated newspaper editions and products, its parent company Multimedia Nova Corporation and its affiliates and related entities and their affiliated newspapers and products. By uploading or otherwise posting any Content on MyTownCrier.ca, you represent and warrant: (i) you own or otherwise have all necessary rights, including but not limited to copyrights, to the content you provide and the rights to use it as provided in this Terms of Service; (ii) all information you provide is true, accurate, current and complete, and does not violate these Terms of Service; and, (iii) the content will not cause injury to any person or entity. For any user-uploaded content that a visitor believe infringes upon any copyrights that they own, please contact us pursuant to the procedures outlined in our corporate Privacy Policy.
As a registered TownHALL Member, you agree not to submit Content that:
• is unlawful, libelous, defamatory, pornographic, harmful, threatening, abusive, harassing, or invasive of another's privacy, or harms minors in any way, or harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
• falsely claims to be submitted by another person or entity, or falsely states or otherwise misrepresents your affiliation with another person or entity;
• infringes on any patent, trademark, trade secret, copyright or other proprietary rights of any party, or Content that you do not have a right to make available under any law or under contractual or fiduciary relationships;
• includes personal or identifying information about another person, or uses the name or likeness of another person without that person's explicit consent;
• is fraudulent, false, deceitful, deceptive, misleading, misinforms or uses "bait-and-switch" tactics;
• constitutes or contains "junk mail," "spam," "chain letters," "pyramid schemes," unsolicited commercial advertisement, "affiliate marketing," or "link referral code";
• constitutes or contains any form of advertising or solicitation if (1) posted in areas which are not designated for such purposes; or (2) emailed to our website users who have requested not to be contacted about other services, products or commercial interests;
• advertises any illegal services or the sale of any items the sale of which is prohibited or restricted by applicable law, including, without limitation, items the sale of which is prohibited or regulated by the province of Ontario or government of Canada;
• contains software viruses, worms, trojan horses, or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
• disrupts the operation of any of the services of this website with an excessive number of messages (flooding attack) to this website, or that otherwise negatively affects other users' ability to use the website; or that employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of Content.
Additionally, you agree not to:
• contact anyone who has asked not to be contacted or otherwise "stalk" or harass anyone;
• collect personal data about other users for commercial or unlawful purposes;
• use automated means, including scripts, spiders, robots, crawlers, data mining tools, or the like to download data from or upload data to any part of this website; or
• attempt to gain unauthorized access to the computer system of the Town Crier or of its affiliated editions and products or its parent company Multimedia Nova Corporation, or to any other user's computer network systems, or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, any of this Site's services and features.
You acknowledge that we do not pre-screen or approve all Content, but that MyTownCrier.ca shall have the right (but not the obligation) in its sole discretion to refuse, delete or move any Content that is available via the Site, for violating the letter or spirit of the Terms or for any other reason. MyTownCrier.ca reserves the right to delete any Content at any time, for any reason or no reason.
For all such information and material, you grant MyTownCrier.ca and its affiliated newspaper editions, its parent company Multimedia Nova Corporation and its affiliates and related entities and their affiliated newspapers, a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, copy, modify, display, archive, store, distribute, reproduce and create derivative works from such information, in any form, media, software or technology of any kind now existing or developed in the future. You agree that regardless of your location any disputes arising out of your use of this website shall only be prosecuted in the municipal Court for the City of Toronto, Ontario, or the Ontario Provincial district court for the Province of Ontario.
MyTownCrier.ca is provided for the personal use of its visitors. Users of MyTownCrier.ca may not reproduce, republish or redistribute material from the Site in any form without permission of the Town Crier or the original copyright holder. Other than content that users submit in accordance with the terms of this Agreement, most of the material including graphics, text, design, buttons, logos, images, and icons, as well as the selection, assembly, and arrangement of the site, are the sole property of Multimedia Nova Corporation or its affiliates. Users of the this Site and any other Multimedia Nova Corporation website may not modify, reproduce, republish, or distribute any material from those websites in any form without the prior written permission of Multimedia Nova Corporation or the original copyright holder.
